What Is Internet Sexual Exploitation Of A Child?

Colorado Revised Statute 18-3-405.4 defines internet sexual exploitation of a minor as knowingly inviting, harassing, or enticing a person you know or believe to be 14 or younger through the use of a computer, telephone, or data network to do any of the following:

  • Expose or touch their own or another person’s intimate parts
  • Observe their intimate parts

Potential Penalties For Internet Sexual Exploitation Of A Child

Internet sexual exploitation of a child is a class 4 felony in Colorado. Criminal penalties include between two to six years in prison, a fine of $2,000 to $500,000, and parole. Keep in mind that minimum penalties for sex offenses cannot be negotiated in Colorado, so even if the judge or prosecutor wants to give you a lighter sentence, the minimum sentence must usually be carried out as stated by the legislature.

In addition to imprisonment and fines, you can also be ordered to undergo a psychiatric evaluation and complete treatment as a condition of your parole. Failure to complete treatment is considered a violation of your parole and can result in additional penalties.

You could also be required to register as a sex offender, which allows neighbors, employers, landlords, and others to find out about the conviction and potentially block you from opportunities to start over.
